As you can see from my profile, I am a strong believer in the wisdom of mediation, negotiation and resolution in matters of family law, child custody, property division and, particularly, divorce. It is not only the more affordable path in a divorce proceeding, but is also much less emotionally stressful, and I consistently recommend that my clients consider it as their first, best option.
A powerful tool
Make no mistake: If you are my client, your interests come first and I am committed to protecting your rights and advocating for everything you want and need.
However, if both parties in a divorce are willing to set aside their emotions and consider instead the long-term benefits of an amicable settlement, I am all for it. In my experience, it is better for both parties and their children when legal issues such as child custody and property division are resolved in a conference room rather than in a courtroom.
A better success rate
Mediation gives both parties the opportunity to control their own fate. If you let a judge do it, you can always blame the judge if you are unhappy. If you have mutually worked out an agreement, though, you are much more likely to live with and abide by it. Many more mediated agreements are successful than court rulings, and there are many ways to get people to come around to an agreement.
More reasonable solutions
Mediation involves recognizing what is best for everyone, including any children involved. It allows people to stay in control of their lives rather than relying on a judge who does not know the family. Mediation allows you to come up with solutions that are more flexible and better suited to the individuals involved.
